General Terms and Conditions
La Val Hotel & Spa
Scope of application
These General Terms and Conditions (hereinafter referred to as "GTC") apply to the provision of rooms and/or conference and banquet facilities as well as to all other related services and deliveries of Brigels Gastro AG (hereinafter referred to as "BGAG") to guests and event organisers (hereinafter collectively referred to as the "Contracting Party"). They form an integral part of each individual contract between BGAG and the Contracting Party. Individual agreements take precedence over these GTC. Deviations from these GTC require an express agreement in order to be valid. Conflicting general terms and conditions of the Contracting Party shall only apply if BGAG has expressly agreed to their validity.
Hotel bookings, restaurant, spa
This part of the GTC regulates the contractual relationship between the Contracting Party as a hotel guest and BGAG.
1. General
1.1 Conclusion of contract
The contract between BGAG and the Contracting Party is concluded either with written confirmation of the reservation by BGAG or – in the case of bookings without signature – with express acceptance of the booking by BGAG. Until this time, BGAG is entitled to allocate provisionally reserved rooms and/or premises to other parties.
1.2 Service, payments and prices
BGAG undertakes to provide the services ordered by the Contracting Party and promised by BGAG in writing. All prices are in Swiss francs (CHF) and include statutory value added tax (VAT) at the applicable rate.
BGAG may demand a deposit. The amount, due date and payment deadline of the deposit will be communicated to the Contracting Party in writing, in particular in the reservation confirmation. If the Contracting Party does not pay the deposit on time, BGAG is entitled to withdraw from the contract after setting a reasonable grace period. The Contracting Party is liable for the proven and appropriate damage caused as a result.
If BGAG does not require a deposit, the entire invoice amount must be paid by credit card (Mastercard, VISA, American Express), debit card (EC/Maestro, PostFinance) or in cash at the latest upon departure. If payment on account is agreed, the entire invoice amount is due 10 days after the invoice date. If the Contracting Party is in default of payment, BGAG may charge default interest of 5% per annum in accordance with Art. 104 para. 1 CO.
2. Liability
2.1 Limitation of liability
The Contracting Party shall be liable to BGAG in accordance with the statutory provisions for damages and losses caused by it or its accompanying persons. The statutory provisions apply to items brought in by hotel guests, in particular Art. 487 et seq. CO. BGAG shall be liable for vehicles parked in the hotel car parks or in the hotel underground car park in accordance with the statutory provisions and in the event of its own fault, unless custody or guarding has been expressly agreed.
BGAG is liable (contractually and/or non-contractually) for direct damages in the event of intent and gross negligence. In the event of slight negligence, BGAG is only liable if this is mandatory by law or BGAG has expressly assumed liability. Mandatory statutory provisions are reserved, in particular the statutory liability provisions for items brought in by hotel guests.
2.2 Withdrawal from the contract by BGAG
BGAG shall be entitled to withdraw from the contract in whole or in part if objectively material circumstances that were not foreseeable at the time of conclusion of the contract and for which BGAG is not responsible – in particular force majeure – make the provision of the services owed impossible or significantly more difficult, in whole or in part. BGAG shall inform the Contracting Party immediately of the withdrawal. Advance payments for services not yet rendered will be refunded; further claims of the Contracting Party are reserved within the framework of mandatory statutory provisions.
3. Hotel rooms
3.1 Arrival and departure times
Hotel rooms are ready for occupancy from 3.00 p.m. on the day of arrival and must be vacated before 11.00 a.m. on the day of departure. Late check-outs until 5.00 p.m. are possible subject to availability, with a fee of 25% of the daily rate.
Extra beds, dogs and underground parking spaces are subject to an additional fee.
3.2 Cancellation policy
The following cancellation conditions apply in the event of cancellation of bookings, no-shows and early departures.
The cancellation of the booking of individual hotel rooms (up to a total of 3 rooms) must be received by BGAG at least 5 days before the date of arrival. Cancellation can be made free of charge up to 5 days before arrival.
An exception applies to the high season (21 December to 5 January). Cancellation can be made free of charge up to 21 days before arrival.
In the event of a cancellation less than 5 days before arrival, or less than 21 days before arrival during the high season, a cancellation lump sum of 100% of the total price is owed, in each case less saved expenses and taking into account any other assignment or re-letting. The lump sum is only owed to the extent that it corresponds to the proven, necessary and reasonable damage incurred by BGAG.
BGAG must receive the cancellation of a group booking (from a total of 4 rooms) by the following deadlines:
- Up to 10 rooms: 14 days before arrival
- From 11 rooms: 42 days before arrival
In the event of a cancellation after the above deadlines, the Contracting Party owes the following cancellation lump sums, in each case less saved expenses and taking into account any other assignment or re-letting. The lump sums are only owed to the extent that they correspond to the proven, necessary and reasonable damage incurred by BGAG:
- Up to 10 rooms, 7–13 days before arrival: 50% of the total sum of all overnight stays
- Up to 10 rooms, from 6 days before arrival: 100% of the total sum of all overnight stays
- From 11 rooms, 21–41 days before arrival: 50% of the total sum of all overnight stays
- From 11 rooms, from 20 days before arrival: 100% of the total sum of all overnight stays
The following also applies to all cancellations: services already provided or bindingly triggered by BGAG and its assistants or partners are only to be paid to the extent of the costs actually incurred and not recoverable.
4. Wellness & Spa / Fitness / Games Room
4.1 Reservation
To ensure the availability of therapists, all treatments should be booked before the stay if possible.
4.2 Disclaimer
The Contracting Party is obliged to notify any contraindications (such as pregnancy, high blood pressure or illness) before treatment. BGAG's statutory duties of care and liability remain unaffected. In all other respects, BGAG's liability is governed by the statutory provisions and, subject to mandatory law, only exists in the event of its own fault.
4.3 Dress code
It is possible to change in the changing area. Keys for the lockable lockers can be obtained at reception. Swimwear is mandatory in the pool area. The entire sauna area is a nude zone.
4.4 Sauna area
Use of the sauna area is not permitted for guests under the age of 16.
4.5 Quiet zone
The spa area is intended as a relaxation zone. In the event of non-compliance with this guideline, BGAG reserves the right to ask persons to leave the spa area.
4.6 Children
Access to the indoor and outdoor pool is permitted under the supervision of parents. We attach great importance to a quiet and orderly spa operation.
4.7 Fitness area
Hotel guests aged 16 and over have free access to a cardio room. Use is at the guest's own responsibility and subject to BGAG's statutory liability. The person responsible is liable for culpably caused and verifiable damage to equipment in accordance with the statutory provisions.
4.8 Games room
A free playroom is available for children. Use is at the guest's own responsibility and subject to BGAG's statutory liability.
No childcare or supervision is offered in the playroom. The duty of supervision lies with the parents or accompanying persons.
4.9 Spa cancellation policy
Treatments can be cancelled free of charge up to 24 hours before the agreed appointment. In the event of a later cancellation or no-show, BGAG is entitled to charge appropriate, verifiable compensation for the booked treatment, taking into account saved expenses and any reassignment.
4.10 Use of the wellness area after check-out
Use of the hotel's own wellness area is free of charge for hotel guests on the day of arrival and during the duration of their stay. If further use of the wellness area is offered after check-out, the fee is CHF 20.00 per person and day.
Seminars, Banquets, Weddings
This part of the GTC regulates the contractual relationship between the Contracting Party as the organiser and BGAG.
5. Reservations
A contract is concluded between the organiser and BGAG when either an offer from BGAG has been confirmed in writing by the organiser, or an enquiry by the organiser has been confirmed in writing by BGAG.
Changes to the offered services are only binding if they have been confirmed in writing by BGAG.
The acceptance period for offers from BGAG is 14 days in the absence of any other agreement. After that, BGAG is no longer bound by the offer. BGAG also reserves the right to withdraw from an offer for good cause before expiry of the acceptance period. BGAG recommends visiting the offered premises in advance for every reservation.
6. Changes in the number of participants and event time
The organiser is obliged to notify BGAG of any changes in the number of participants as early as possible. BGAG generally endeavours to reallocate unused reservations under the same conditions. If this is successful, the organiser will not be charged any costs.
BGAG must be notified of the exact number of participants at least 48 hours before the event. If more participants than communicated take part in the event, the actual number of participants forms the basis for calculation. BGAG guarantees provision of the agreed services on the agreed conditions for up to 5% additional participants. If the number of participants exceeds this, BGAG will make every effort to cater for all guests, but cannot guarantee this.
In the event of a deviation of more than 10% in the number of participants, BGAG may adjust the agreed prices if this is necessary for an objective reason, in particular due to demonstrable additional or reduced effort. BGAG may provide other premises, provided this is objectively justified and does not constitute a significant deterioration for the organiser. In the event of official requirements or safety reasons, BGAG may allocate other suitable premises.
If the number of participants at seminars and banquets is reduced by more than 10% compared to the confirmed number of participants, BGAG will charge the following costs for no-show participants exceeding this tolerance (in each case less saved expenses and taking into account any other award):
- Up to 60 days before the event: no costs
- 59 to 30 days before the event: 50% of the agreed services
- 29 days or fewer before the event: 100% of the agreed services
If individual services had not yet been determined at the time of the change in the number of participants, BGAG may charge compensation of no more than CHF 500.00 per person, but only to the extent of the necessary and reasonable costs actually incurred and no longer avoidable.
In the event of a reduction in room bookings, the regulation under No. 3.2 applies.
The organiser shall provide BGAG with all information required for the smooth running of the event at least 10 days before the event.
If the agreed start and end times of the event are postponed, the resulting costs may be charged by BGAG. This does not apply if BGAG is responsible for the postponement.
7. Booking of hotel rooms
The need for hotel rooms in connection with an event must be notified to BGAG at least 10 days before the event. The organiser is only entitled to the provision of rooms if these were part of the booking for the entire event. BGAG may invoice the room price in accordance with No. 3.2 if reserved rooms are not used and cannot be allocated elsewhere.
Hotel rooms must be occupied from 3.00 p.m. on the day of arrival and vacated before 11.00 a.m. on the day of departure.
Extra beds, dogs and underground parking spaces are subject to an additional fee.
8. Cancellation by the organiser
Cancellations of events must be notified to BGAG as early as possible and in writing. Receipt of the written declaration by BGAG is decisive. Services already provided or bindingly triggered by BGAG and its partners vis-à-vis third parties are only to be paid to the extent of the costs actually incurred, non-recoverable and proven, insofar as these are not already included in the cancellation costs below.
If the event is cancelled in its entirety by the organiser, BGAG can claim the following compensation (in each case less saved expenses and taking into account any other award):
- Up to 120 days before the agreed date: free cancellation
- 119 to 90 days before the event: 25% of the reserved services
- 89 to 60 days before the event: 50% of the reserved services
- 59 to 30 days before the event: 75% of the reserved services
- 29 days or fewer before the event: 100% of the reserved services
For partial cancellations (seminars and banquets), the regulation under No. 6.3 applies. Receipt of the written cancellation by BGAG is decisive for the calculation.
If the price of the reserved services (menu and drinks) has not yet been determined, an amount of CHF 120.00 per person shall be used as the basis for calculation. Compensation is, however, limited to the costs actually incurred, unavoidable, non-recoverable and proven necessary and reasonable.
9. Bringing your own food and drinks
The organiser is generally not permitted to bring their own food and beverages. Exceptions require a written agreement with BGAG. In these cases, a service fee is charged as follows:
- Corkage, bottle of 0.75 litres of wine: CHF 45.00
- Corkage, bottle of 1.5 litres of wine: CHF 80.00
- Corkage, bottle of 3 litres of wine: CHF 160.00
- Wedding cake/dessert: CHF 3.00 per person
Appropriate proof of hygiene and production must be provided for foodstuffs.
10. Fire regulations / other safety regulations / attaching decorative material
The organiser undertakes to comply with BGAG's fire regulations, in particular keeping escape routes clear and complying with the smoking ban, etc.
The organiser is also responsible for ensuring that no more persons are admitted than correspond to the capacity of the room in question. The maximum numbers specified by BGAG are binding. In the event of a violation, the organiser is liable for any resulting damages and additional costs. BGAG's liability is based on the statutory provisions and, subject to mandatory law, only exists in the event of its own fault.
Attaching decorative materials or other objects to walls, doors and ceilings requires BGAG's prior consent. The organiser is liable in accordance with the statutory provisions for culpably caused, proven, necessary and reasonable damages and costs.
11. Video surveillance
The hotel is under video surveillance to protect people and property. Video surveillance is indicated by clearly visible signs. Further information — in particular on the responsible party, the purpose of processing, the monitored areas, the storage period and the rights of data subjects — can be found in BGAG's privacy policy.
Video recordings are protected from unauthorised access by appropriate technical and organisational measures and are only consulted in connection with a specific incident. They are generally deleted after 72 hours, unless needed longer to clarify an incident or to enforce or defend legal claims. In all other respects, BGAG's privacy policy applies.
12. Printed materials / media advertisements
The use of BGAG's logos or images in any form by the organiser requires BGAG's prior written permission. If publication takes place without appropriate consent, BGAG is entitled to withdraw from the contract. The organiser is liable to BGAG for the resulting damage.
13. Surcharges
From 1.00 a.m. onwards, the organiser will be charged CHF 45.00 per hour, per employee.
14. Payment terms
14.1 BGAG invoices are to be paid without deduction within 10 days of the invoice date. In the event of default of payment, BGAG is entitled to charge default interest of 5% p.a. Complaints must be reported in writing within the payment period, but no later than within a reasonable period after discovery. Invoiced services are only considered to have been provided completely and properly to the extent that an inspection and complaint were objectively possible and reasonable, and no defects are affected that would not have been recognisable without a reasonable inspection.
14.2 BGAG may demand a reasonable deposit. The amount of the deposit, the payment deadline and the payment date will be communicated to the organiser in writing in the offer or booking confirmation. The deposit is due on the date specified there. For reservations from abroad or with a foreign billing address, BGAG may demand a deposit up to the full amount of the reserved services; the amount and payment date will be communicated in the offer or booking confirmation. If the organiser is in default with payment of a due deposit, BGAG is entitled to withdraw from the contract after a written reminder and the unused expiry of a reasonable grace period. The deposit will be credited against the invoice amount.
14.3 In the event of default, BGAG may charge necessary, actually incurred and reasonable costs for reminders and address enquiries. Further costs are only owed if they are legally owed or demonstrably necessary and appropriate in the individual case.
15. Withdrawal from the contract by BGAG
15.1 BGAG is entitled to withdraw from the contract for good cause for which it is not responsible. Important reasons include, in particular, official requirements or prohibitions, cases of force majeure, as well as security reasons or other circumstances that significantly hinder or make provision of the service impossible. As far as possible and reasonable, BGAG will support the organiser in finding suitable replacement premises.
15.2 BGAG may also withdraw from the contract under the following conditions:
- There is a reasonable, fact-based risk that the event or its participants will significantly affect the smooth running of the business, security or reputation of the hotel or its guests.
- The event was booked under misleading or false statements of material facts, or for a substantially different purpose than communicated, and the organiser did not immediately remedy the resulting significant breach of duty despite being requested to do so.
- Third parties involved by BGAG in the organisation of the event at the organiser's instigation are wholly or partly prevented from providing their service and no suitable substitute is available, so that the event is significantly impaired or rendered impossible.
15.3 BGAG declares its withdrawal immediately after becoming aware of the reasons justifying it and informs the organiser accordingly. Insofar as BGAG is not responsible for the reason for withdrawal, the organiser has no claims for damages; mandatory statutory claims are reserved.
16. Liability
16.1 The organiser is liable for the entire invoice amount, including services drawn on by its employees, assistants and event participants. Exceptions must be agreed in writing.
16.2 The organiser is liable in accordance with the statutory provisions for damages and losses culpably caused by it, its assistants or event participants. BGAG may require appropriate security from the organiser insofar as this is objectively justified based on specific circumstances.
16.3 BGAG is liable for items brought in, as well as for vehicles parked in the hotel car parks or in the hotel underground car park, in accordance with the statutory provisions.
16.4 Insofar as BGAG provides technical or other equipment for the organiser, or procures it from third parties, it acts in the name and for the account of the organiser. The organiser is liable for its careful handling and return, and indemnifies BGAG against all third-party claims arising from its use.
16.5 In all other respects, BGAG is liable for direct damages in the event of intent and gross negligence. In the event of slight negligence, BGAG is only liable in the case of mandatory statutory liability or an express assumption of liability; mandatory law is reserved.
Final provisions
17. Changes and additions
Changes or additions to the contract, additional agreements or these terms and conditions must be made in writing or text form for evidentiary purposes. This also applies to any waiver of this formal requirement. Unilateral changes by the Contracting Party or the organiser are invalid.
18. Place of performance and payment
The place of performance and payment for all contracts with BGAG is BGAG's registered office in Brigels.
19. Partial invalidity
Should individual provisions of these GTC be or become inadmissible, invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected. The parties will cooperate in good faith to replace the provision in question with a valid provision that comes as close as possible to the economic purpose of the invalid provision.
20. Applicable law and place of jurisdiction
All contractual relationships between the Contracting Party and BGAG, as well as these GTC, are subject to Swiss substantive law. Mandatory statutory provisions are reserved.
The mandatory statutory places of jurisdiction apply in relation to consumers. In relation to Contracting Parties who do not act as consumers, the registered office of BGAG is the place of jurisdiction to the extent permitted by law.
By signing, the Contracting Party confirms that it has taken note of the content of these General Terms and Conditions and agrees to their validity. In the case of bookings without a signature, these GTC only apply if they were made reasonably accessible to the Contracting Party before conclusion of the contract.
