Right of Withdrawal

1. Scope of Application

These voucher conditions apply to all vouchers issued by LA VAL Hotel & Spa via the official voucher shop, via ADDITIVE+ VOUCHERS, directly at the hotel or through other points of sale authorised by LA VAL Hotel & Spa.

By purchasing a voucher, the buyer accepts these voucher conditions.

2. Contracting Party

The contractual partner for the purchase and redemption of a voucher is exclusively the LA VAL Hotel & Spa. ADDITIVE+ VOUCHERS is the technical platform through which the voucher shop can be operated and the voucher order can be processed.

3. Types of vouchers

In particular, the LA VAL Hotel & Spa can offer the following vouchers:

• Vouchers
• Accommodation and stay vouchers
• Restaurant vouchers
• Spa and treatment vouchers
• Product and service vouchers
• Promotional and discount vouchers

Additional or different conditions may apply to individual voucher types. These are stated in the respective voucher offer.

4. Conclusion of the voucher contract

Upon completion of the order process, the buyer submits a binding offer to purchase the selected voucher. The voucher contract is concluded with the confirmation of the order by the LA VAL Hotel & Spa or by the voucher system used. The order and the information relevant to the conclusion of the contract are confirmed electronically. The LA VAL Hotel & Spa ensures that the legal requirements for electronic business transactions in accordance with Art. 3 lit. s UWG are complied with in the voucher shop. The information relevant to the conclusion of the contract is made available to the buyer before the order is completed.

5. No general statutory right of withdrawal

Under Swiss law, there is generally no general statutory right of withdrawal for vouchers purchased online. A return or cancellation of a voucher is therefore only possible if this is expressly provided for in these voucher conditions or if the LA VAL Hotel & Spa voluntarily agrees to such a return. Mandatory statutory rights are reserved.

6. Voluntary right of return

The LA VAL Hotel & Spa grants a voluntary right of return of 14 days from the conclusion of the contract for vouchers purchased online, provided that the voucher has not yet been redeemed in whole or in part within this period. The revocation or return must be made within this period in writing by e-mail to the LA VAL Hotel & Spa.

Vouchers that have already been partially or fully redeemed can no longer be returned. In the event of an effective return, the voucher value paid will generally be refunded via the original means of payment.

Individual or already provided services as well as any transaction or shipping costs can be excluded from the refund, provided that this was transparently stated at the time of the order and is legally permissible.

7. Validity

The validity period of the voucher is indicated on the respective voucher.

Unless a different period of validity is specified for the respective voucher, the voucher can generally be redeemed for 5 years from the date of issue. This period is considered a contractual forfeiture period. Mandatory statutory limitation periods are reserved. After expiry of the validity period stated on the voucher, the voucher can no longer be redeemed.

An extension of the validity period can be granted on request in individual cases and subject to availability. There is no entitlement to an extension.

8. Redemption

Vouchers can only be redeemed at the LA VAL Hotel & Spa and only for the services specified on the voucher. Redemption is only possible after prior verification of the validity and the available voucher value.

Prior reservation may be required for overnight stays, restaurant visits, spa services and other services. The redemption of a voucher does not automatically guarantee the availability of a particular service or date.

9. Partial redemption of vouchers

Value vouchers can also be partially redeemed, provided that technically possible and in accordance with the voucher conditions. In the case of partial redemption, the unused remaining credit remains valid for later redemption within the validity period of the voucher. A cash payment of the remaining credit is excluded.

10. Cash Payment

A payment of the voucher value in cash or a refund of the voucher value to a bank account is generally excluded. The voucher value can only be used for the services provided for on the voucher.

Mandatory statutory claims are reserved.

11. Transferability

Vouchers are generally transferable, unless otherwise expressly stated on the voucher. The transfer of a voucher does not have to be notified to LA VAL Hotel & Spa in advance. A transfer does not constitute a claim to a change in the voucher conditions or to an extension of the validity period.

12. Promotional and discount vouchers

Promotion, discount and incentive vouchers may be subject to special conditions.

In particular, they can:

• be valid only within a certain period of time;
• apply only to certain benefits;
• be dependent on minimum turnover;
• cannot be combined with other actions;
• be non-transferable;
• be excluded from cash payment.

The conditions stated in the voucher offer are decisive.

Promotional vouchers are not entitled to the same conditions as regularly purchased vouchers.

13. Discount vouchers and vouchers

A discount voucher only entitles the holder to the discount stated in the voucher and does not represent a monetary value. A voucher, on the other hand, corresponds to the amount shown on the voucher and can be used as a means of payment for the intended services within the framework of the respective voucher conditions. A conversion of a discount voucher into a voucher is excluded.

14. Non-combinable offers

Unless expressly stated otherwise, vouchers cannot be combined with other discount campaigns, special offers or promotions. The conditions of the respective voucher are decisive.

15. Lost or misused vouchers

The holder of a voucher bears the risk of loss, theft and unauthorised use of the voucher or voucher code. In the event of loss, theft or misuse, there is generally no entitlement to compensation.

The LA VAL Hotel & Spa may block a voucher if there are concrete indications of misuse, counterfeiting or other unlawful use.

16. Counterfeiting and Abuse

Vouchers may not be reproduced, manipulated or misused in any other way.

In the event of reasonable suspicion of forgery or misuse, the LA VAL Hotel & Spa may refuse to redeem the voucher and block it.

17. Unredeemable or faulty vouchers

If a voucher cannot be redeemed due to a technical error in the voucher system, the guest is obliged to contact the LA VAL Hotel & Spa before redeeming it. The hotel will check the validity and the existing voucher value on the basis of the voucher or order data and, if necessary, offer an appropriate solution.

18. Prices and Payment

The prices shown in the voucher shop at the time of ordering apply.

Payment is made via the payment methods offered in the voucher shop.

A voucher will only be activated or released for redemption after full receipt of payment, unless otherwise provided for in the respective payment method.

19. Shipping and electronic delivery

Depending on the shipping method chosen, the voucher can be delivered electronically or in physical form. The address or e-mail address provided by the buyer is decisive for delivery. The buyer is responsible for entering the contact details provided correctly.

20. Liability

The LA VAL Hotel & Spa is liable for damages in accordance with the mandatory statutory provisions. The LA VAL Hotel & Spa assumes no liability for damages caused by the incorrect provision of an e-mail or shipping address, by loss of the voucher after proper delivery or by passing on the voucher code to third parties.

21. Applicable law and jurisdiction

Swiss law is applicable to the voucher contract, to the exclusion of conflict of laws to the extent permitted by law. Mandatory provisions for the protection of consumers are reserved. To the extent permitted by law, the place of jurisdiction is at the registered office of LA VAL Hotel & Spa. Mandatory provisions on jurisdiction in favour of consumers, in particular Art. 32 of the Code of Civil Procedure, are reserved.

22. Final Provisions

Should individual provisions of these voucher conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by an effective provision that comes as close as possible to the economic purpose of the invalid provision.

The version of these voucher conditions published at the time of the voucher purchase applies.

23. Data protection

When purchasing and redeeming vouchers, personal data of the buyer or holder will be processed. Details on data processing, the rights of the data subjects and the contact details of the responsible body can be found in the privacy policy of the LA VAL Hotel & Spa, which can be accessed under www.laval.ch.
